India’s IP Landscape- Growing by Leaps and Bounds!

With fast paced innovation, the IP landscape in India has witnessed a tremendous surge in the past few years. A recent news release by the Press Information Bureau (PIB) of India, reports that IP filings in the last five years have increased by 44%.
The growth rate of various IP rights in India in the last 5 years have been reported by PIB in July 2025 as under:

One of the most significant aspects that has emerged in the past few years is the phenomenal increase witnessed in trademarks and patent filings from domestic applicants. It is pertinent to mention here that earlier in view of various compelling factors, the IP filings domestic applicants were relatively less. An analysis of patent filings by domestic v. foreign applicants from 2019-2024 is illustrated below:

Similarly, domestic trademark filings are 97.27% of total trademark filings for the period 2023-2024
Factors responsible for this surge!
India has been remarked as a fertile and favourable destination for investments. With a growth of 6.5% GDP in 2024-25, India is poised to become one of the fastest-growing major economies in the world. This has led to a tremendous spurt of business opportunities and establishments in India.
Additionally, the schemes and initiatives introduced by the Government of India have played a paramount role in promoting and encouraging businesses, specifically startups and MSME’s to file for their IP rights. The Government in the year 2016 introduced the SIPP scheme (Startup Intellectual Property Protection Scheme), which has significantly boosted the IP filings by startups in India.
The various IPR benefits under the SIPP scheme include empanelment of IPR facilitators by the Government who assist in filing of IP applications by startups, fast-track examination of patent applications, significant rebate in filing of IP applications (The Scheme offers a rebate of 80% in fees for filing patent applications and rebate of 50% in fees for filing of trademark applications by startups in India), as well as Government bearing the professional fees incurred in filing of applications by IP facilitators. It is indeed noteworthy to mention that in the past 5 years, IP filings by startups have witnessed an ascent.

The aforesaid numbers speak volumes when it comes to the burgeoning innovative and IP landscape in India. This paradigm shift is a testament of augmented IPR awareness coupled with initiatives and schemes to promote protection and enforcement of IP rights.
A robust IP enforcement regime
Another crucial aspect that cannot be overlooked, when we traverse through the Indian IP landscape is the IP enforcement regime in India, which pursuant to the establishment of Intellectual Property Division (IPD) in various High Courts (At present IPD have been established in the Hon’ble High Courts of Delhi, Madras and Calcutta. The IPD comprises Bench that deal with IP cases only), has significantly strengthened the IP enforcement practices in India.
The IPD has been instrumental in passing judgments and orders which have adequately protected the rights of IP owners and in numerous cases has taken a proactive step in awarding pecuniary damages to the in cases of IP infringement.
When it comes to the rate of disposal, then the IPD Report of 2023-2024 released by the Hon’ble Delhi High Court provides the rate of disposal across different subject matters as under:

The aforesaid numbers illustrating the IP regime in India certainly sets the stage for India’s evolving Innovative and IP landscape. The policies and practices accentuate the fact that India is an IP-friendly jurisdiction and has a robust IP ecosystem, ensuring that the rights of IP owners are intact and secured.
